Application to fell one sycamore tree to provide clearance to property and reduce risk of falling. Seeking confirmation that the tree is not part of the TPO.

FELLING OF 1 NO. SYCAMORE Works to be carried out - Felling / crowning - to provide sufficient clearance to property, and reduce risk of falling. Currently the tree's tips of branches are starting to brush against the building in winds. The height of the tree has increased in recent years, and is now taller than the property. If the tree was to fall it could either hit the house, fall over the pedestrian pavement or road. Alongside the confirmation of a) the ability to fell/crown the tree; we are also looking for b) confirmation that the tree in question is not actually part of the TPO, and that records can be amended (see below for further reasoning) TPO - Property is subject to a TPO-22 Looking at the TPO document, the individual tree is located in the area numbered A39. However the type of tree we want to fell/or crown (a Sycamore), isn't named as one of the protected trees in that A39 area (The several Ash, Oak, Alder, Beech, Lime, Chestnut, Willow and Elm). Also as you will see from the map in the 1976 order, the currently properties of #1 and #3 didn't exist at this time. And as such this is now an individual tree, rather than part of the larger woodland area alongside Bradshaw Brook (A39). Also having reviewed some of the previous application requests in the same area TPO-22 A39 area (see document 94610_15-Officers_Report-517631.pdf), The Councils Tree & Woodland Officer (CT&WO) noted that "Sycamore trees are not included within area A39 of the schedule of the Bolton DC23:022 (Bradshaw) TPO 1976 and are therefore are not subject to a requiring the Councils authorisation for works." As such we see this as a possible precedent for this individual Sycamore tree to be outside of the TPO, and therefore any works not needing authorisation. However we're making this application for confirmation.
